“WPC RTW Candidate” Mobile Application User Licence Agreement

This Licence Agreement governs your use of the Wpc RTW Candidate mobile application (“App”), a product of WORK PERMIT CLOUD LIMITED (“WPC”). By downloading or using the App, you (“Candidate”) agree to the terms of this Agreement.

1. Definitions

  • “Personal Data” refers to any information that relates to an identified or identifiable individual, such as Passport, Birth Certificate, Biometric Residence Permit (BRP), Certificate of Sponsorship (COS), Asylum Registration Card (ARC), and cookie data captured by the App.
  • “Right to Work Checks” refers to the verification process conducted under the guidelines set forth in the UK Home Office's guidance, “Employer's Guide to Right to Work Checks.”
  • “WPC” refers to WORK PERMIT CLOUD LIMITED, registered in England & Wales, with Company Number 12909694, Registered Office: The Gherkin Level 28, 30 St. Mary Axe, London, EC3A 8BF.

2. Licence Grant

WPC grants you a non-exclusive, non-transferable, revocable licence to use the WpcRtwCandidate App solely for the purpose of verifying and sharing your right to work in the UK with potential employers.

3. User Obligations

  • Consent to Data Processing: By using the App, you give express consent to WPC and any appointed third-party Identity Service Providers (IDSPs) to process your Personal Data to perform Right to Work checks as required by employers.
  • Accuracy of Information: You confirm that all Personal Data provided via the App is accurate, up to date, and complete to the best of your knowledge.
  • Compliance with UK Law: You agree to use the App in compliance with UK immigration laws, and to facilitate the statutory excuse for employers as defined in the Immigration, Asylum and Nationality Act 2006.

4. Data Retention and Security

  • Data Retention: WPC will retain your Personal Data only for the duration necessary to fulfil legal obligations, including Right to Work checks, and in compliance with data protection laws, including the UK General Data Protection Regulation (UK GDPR).
  • Security Measures: WPC will implement reasonable technical and organisational measures to safeguard your Personal Data from unauthorised access, use, or disclosure.

5. Liability

  • WPC Liability: WPC will make all reasonable efforts to ensure the accuracy and reliability of the App and the services it provides. However, WPC will not be liable for any errors, omissions, or delays in the Right to Work verification process.
  • Indemnity: You agree to indemnify and hold WPC harmless from any claims, liabilities, damages, losses, or expenses arising out of your misuse of the App, failure to provide accurate information, or breach of this Agreement.

6. Termination

WPC reserves the right to terminate or suspend your access to the App at any time without notice if you breach any terms of this Agreement or for operational reasons.

7. Amendments to the Agreement

WPC may modify this Agreement from time to time to comply with changes in the law or to reflect updates to the App. You will be notified of any significant changes, and continued use of the App signifies your acceptance of the modified terms.

8. Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
