Wpc RTW Employer and Wpc RTW Candidate Mobile Application Terms and Conditions

1. Definitions

  • “WPC”: WorkPermitCloud Limited, registered in England and Wales, with Company Number 12909694 and registered office at The Gherkin Level 28, 30 St. Mary Axe, London, EC3A 8BF.
  • “Employer”: Any organization using the WpcRtwEmployer mobile application to verify an individual's right to work within UK laws.
  • “Candidate”: An individual using the WpcRtwCandidate mobile application to provide information for the purposes of verifying their right to work in the UK.
  • “Personal Data”: Includes any information required from the Candidate for Right to Work checks, such as passport, birth certificate, Biometric Residence Permit (BRP), Certificate of Sponsorship (COS), Asylum Registration Card (ARC), and any cookies or metadata collected during app usage.
  • “Right to Work Checks”: Processes as per the UK Home Office’s “Employer’s Guide to Right to Work Checks” to ensure compliance with immigration laws.
  • “Third Party Service Providers”: Service providers who process Personal Data on behalf of WPC for verification purposes.

2. Application Purpose

The Wpc RTW Employer app allows Employers to collect necessary details for Right to Work checks, including:

  • Organisation name
  • Job position
  • Candidate’s email, name, and phone number
  • Work hours and working hours compliance

The Wpc RTW Candidate app allows Candidates to consent to the processing of their Personal Data for Right to Work checks, which will be shared with Employers via WpcRtwEmployer.

3. Consent and Data Processing

By using WpcRtwCandidate, Candidates explicitly consent to the collection, processing, and retention of their Personal Data by WPC and third-party providers for Right to Work verification.

Employers are responsible for ensuring that all data collected via WpcRtwEmployer complies with the statutory requirements of a Candidate’s right to work, in accordance with their legal obligations.

4. Data Retention and Security

  • Retention Period: WPC will retain Personal Data only for the duration necessary to perform Right to Work checks and as required under applicable law.
  • Security Measures: WPC implements appropriate technical and organisational measures to safeguard Personal Data from unauthorized access, loss, or misuse.

5. Employer and Candidate Obligations

5.1 Employer Obligations

  • Employers must ensure that all information provided for verification is accurate, complete, and up-to-date.
  • Employers are responsible for maintaining the confidentiality of any information obtained through Wpc RTW Employer.

5.2 Candidate Obligations

  • Candidates must ensure that all Personal Data submitted via Wpc RTW Candidate is accurate and up-to-date.
  • Candidates must comply with the requirements of the UK Immigration, Asylum and Nationality Act 2006.

6. Indemnity

Employers and Candidates agree to indemnify WPC from any claims, liabilities, damages, or expenses arising from misuse of the Wpc RTW Employer and Wpc RTW Candidate platforms, breach of these terms, or failure to comply with legal requirements.

7. Limitation of Liability

WPC will use reasonable skill and care in providing the applications but makes no warranty as to the accuracy, reliability, and completeness of the data. WPC is not liable for any direct, indirect, or consequential losses arising from the use of Wpc RTW Employer or Wpc RTW Candidate.

8. Two-Factor Authentication (2FA)

By using our services, you agree to enable and use Two-Factor Authentication (2FA) for enhanced security. You are responsible for safeguarding your 2FA credentials (e.g., codes sent to your mobile or email). Unauthorized sharing or compromise of 2FA credentials may result in limited or suspended access to our services.

9. eVisa Verification Process

To verify your right-to-work status, you agree to participate in the eVisa verification process, which involves using an OTP sent by the UK government. This OTP is essential for obtaining a share code and completing the verification process.

10. Termination

WPC reserves the right to terminate access to either application at any time without notice if these terms are breached.

11. Changes to Terms

WPC reserves the right to update these terms at any time to reflect changes in legal requirements or functionality. Continued use of the apps signifies acceptance of any revised terms.
